Regulation for production and filling licensing
of special equipment
1 General provisions
1.1 Purpose and basis
The Regulation is formulated based on relevant laws and regulations such as Special
Equipment Safety Law of the People's Republic of China, Administrative Licensing Law of
the People's Republic of China and Regulations on Safety Supervision of Special
Equipment, in order to regulate the production (design, manufacturing, installation,
reformation and repair) and filling licensing of special equipment.
1.2 Application scope
The Regulation is applicable to the design, manufacturing, installation, reformation, repair,
and filling licensing of special equipment which are used in the territory of the People's
Republic of China.
1.3 Licensing entity
The agencies performing the production and filling licensing of special equipment are the
State Administration for Market Regulation and the department of provincial people's
government in charge of the special equipment safety supervision-administration (the State
Administration for Market Regulation, hereinafter referred to as ��SAMR��, and the
department of provincial people's government in charge of the special equipment safety
supervision-administration, hereinafter referred to as the provincial special equipment
safety supervision-administration department, are hereinafter collectively referred to as the
issuing authority).
1.4 Licensing catalog
The categories, items, sub-items, parameters and levels (hereinafter collectively referred
to as licensing scope) and the issuing authority of the production and filling licensing of
special equipment are implemented in accordance with the Production Licensing Catalog
of Special Equipment issued by the SAMR; the types, categories and varieties of
equipment in licensing items and sub-items are implemented in accordance with the
Special Equipment Catalog.
1.5 License and the validity period
The special equipment licenses include the "Production License of Special Equipment of
the People's Republic of China�� and the "Filling License of Transportable Pressure
Vessel/Cylinder of the People's Republic of China" (hereinafter referred to as ��licenses��,
with formats shown in Annex A), of which, the validity period is 4 years.
2 Licensing conditions
2.1 General requirements
The applicant of production and filling license of special equipment (hereinafter referred to
as the applicant) shall have legal qualification and the resources suitable for licensing
scope, establish and effectively implement the quality assurance system and safety
management system suitable for the licensing scope, and be equipped with the technical
capability of ensuring the safety performance of special equipment.
2.1.1 Resources
The applicant shall have the following resources suitable for licensing scope and meeting
the production needs.
2.1.2 Quality assurance system
The applicant shall, in accordance with the requirements of the Regulation, establish a
quality assurance system suitable for the licensing scope and implement it effectively;
thereof, the quality assurance system of the special equipment manufacturing, installation,
reformation and repair organizations shall conform to the requirements of Annex M "Basic
requirements for quality assurance system of special equipment manufacturing
organization", that of pressure vessel and pressure pipeline design organizations shall
conform to the requirements of C1.4 and E1.4, and that of transportable pressure vessel
and cylinder filling organizations shall conform to the requirements of C3.7 and D2.7.
2.2 General requirements for resources
2.2.1 Personnel
In resource conditions, the technical personnel shall have professional education
background in science-technology, obtain technical title [Translator note. designation] of
relevant discipline and have relevant working experience.
The safety management personnel, testing personnel and operating personnel in
resources, where included in the administrative licensing of special equipment, shall obtain
the corresponding qualification certificate for special equipment personnel.
2.2.4 Conditions sharing
2.2.4.1 The same organization
(1) For the same applicant applying for different licensing items, the corresponding
licensing conditions specified in Annexes B~L are allowed to be shared;
(2) Where the same licensing sub-item product is jointly completed in multiple
manufacturing addresses (Note 2) of the same applicant, the sum of resources of such
addresses shall meet the licensing conditions specified in Annexes B~L (any other
requirements in Annexes B~L, if available, shall prevail), and a unified quality assurance
system shall be established.
2.2.4.2 Companies and subsidiaries (companies and branches)

3.1 Licensing procedures
Licensing procedures include application, acceptance, appraisal and review, examination
and license issuance.
3.2 Application
3.3 Acceptance
3.3.1 Acceptance
The issuing authority shall accept the application within 5 working days upon receiving the
application data which are complete and conform to the legal form, and issue an electronic
(or written) Special equipment administrative license acceptance decision (hereinafter
referred to as "acceptance decision"). The name and contact information of the entrusted
appraisal and review organization (Note 3) shall be indicated in the acceptance decision.
3.3.2 Correction
The issuing authority shall inform the applicant of all contents to be corrected at the same
time within 5 working days upon receiving the application data which are incomplete or fail
to conform to the legal form, and issue a Correction notice on administrative license
application data of special equipment (hereinafter referred to as "correction notice").
3.3.3 Rejection
In case of any of the following circumstances, the issuing authority shall issue Special
equipment administrative license rejection decision (hereinafter referred to as ��rejection
decision��) to the applicant within 5 working days upon receiving the application data.
3.4 Appraisal and review
3.4.1 General requirements
3.4.2 Procedures and requirements for on-site appraisal and review
3.4.3 Appraisal and review conclusion and report
According to the following requirements, the opinions on appraisal and review conclusion
are be divided into "qualified", "qualified after rectification" and "unqualified".
3.5 Examination and license issuance
The issuing authority shall examine the appraisal and review report and relevant data
submitted by the appraisal and review organization within 20 working days upon receiving
such report and data; where license issuance conditions are met, it shall issue
corresponding license to the applicant, otherwise, it shall issue a "Special equipment
administrative license refusal decision" (hereinafter referred to as "refusal decision") to the
applicant.
3.6 Additional item, change and extension of license
3.6.1 Additional item
3.6.1.1 Meaning
Additional item of the license refers to any of the following circumstances occurring in the
licensed organization within the validity period.
3.6.2 Change of license
3.6.2.1 Meaning
Change of the license refers to any of the following circumstances occurring in the licensed
organization within the validity period.
3.6.2.2 Change of organization name and address
When changing its name or address, the licensed organization shall, within 30 working
days after the change, apply for license change to the original issuing authority and submit
the following data.
3.6.2.3 Address relocation
(1) Upon address relocation, the licensed organization shall, in accordance with the
requirements of 3.6.2.2, apply to the original issuing authority for license change, submit
relevant data and transact the change formalities; for the relocation of manufacturing
address or filling address, the appraisal and review shall be conducted, but it is not
necessary to prepare the trial-manufactured prototype (sample). During the appraisal and
review, attention shall be paid to the checking of resources, and the coverage of the quality
assurance system shall be confirmed;
3.6.2.4 Manufacturing (filling) address cancellation
Upon manufacturing (filling) address cancellation, the licensed organization shall, in
accordance with the requirements of 3.6.2.2, apply to the original issuing authority for
license change, submit relevant data and transact the change formalities. The appraisal
and review shall also be carried out if considered as necessary by the issuing authority.
3.6.2.5 Change of licensing level
The licensed organization, when changing the level of the licensing sub-item, shall apply
to the relevant issuing authority, with relevant licensing procedures and requirements (Note
5) handled in accordance with 3.2~3.5.
3.6.2.6 Licensing scope and validity period of new license
After the license is changed, the licensing scope and validity period of the new license shall
be implemented in accordance with those of the original license; for the cases specified in
3.6.2.3 (2) and 3.6.2.5, the validity period of the new license shall be counted since the
issuing data. The original license shall be withdrawn by the original issuing authority.
3.6.3 License extension
3.6.3.1 General requirements
3.6.3.2 License renewal based on self-declared commitment
The licensed organization, free of administrative penalty, liability accident, equipment
safety performance problem or quality complaint related to special equipment and having
corresponding production performance (Note 6) as specified in Annexes B~L during the
licensed period before the license renewal, may apply for license renewal without appraisal
and review to the issuing authority by submitting data such as self-declared commitment
of continuously meeting the licensing requirements before the expiration of the license
validity period.
3.6.3.3 License validity period
3.6.3.4 Delayed renewal
Before the expiration of the license validity period, when the license renewal is delayed
due to the restructuring or the approved relocation of manufacturing or filling site, the
manufacturing or filling organization shall apply for delayed renewal to the issuing authority
and fill in the license change application form 6 months in advance. Upon application, the
approval documents of relevant government department (or higher authority) on
restructuring or relocation shall be submitted as annexes at the same time.
Upon approval of delayed renewal, the issuing authority shall issue a renewed license with

4.1 License management
4.2 Formats of relevant documents
Formats of documents, such as the license application form, acceptance decision,
correction notice, rejection decision, refusal decision, license change application form and
license re-issuance application form, of the production and filling organizations of special
equipment, shall be implemented in accordance with the relevant document formats
published on the special equipment administrative licensing website of the SAMR.
4.3 Meaning of numerical expression
For the purposes of the Regulation, the fixed numerical value, technical title requirements
or non-destructive testing qualification requirements are the minimum requirements;
relevant expressions such as ��or more/more than�� and ��not less than�� include the numerical
value or requirement stated therein.
4.4 Interpretation authority
The Regulation shall be interpreted by the SAMR.
4.5 Implementation date
The Regulation shall be implemented as of June 1, 2019.
4.6 Abolishment
The following documents and safety technical regulations shall be abolished as of the
implementation date of the Regulation.
