1 Scope
This Rules applies to products that are assessed by self-declaration in China
Compulsory Certification catalogue.
This Rules stipulates the definitions, self-declaration procedures, conformity
information submission and self-declaration requirements, CCC mark, post-market
supervision, and responsibilities and obligations of related parties, etc. for the
self-declaration assessment method of China Compulsory Certification.
2 Definitions
2.1 Producer (manufacturer)
The enterprise with independent legal personality which designs and produces
products or entrusts others to design, produce, and sell in its name/trademark and
shall undertake the main-body responsibility for the product quality.
2.3 Manufacturing enterprise
The enterprise entrusted by a producer (manufacturer) to actually complete the
production and assembly of products.
2.4 Importer
The enterprise legally registered within the territory of China which imports products
from overseas to the Chinese market for selling.
2.5 Seller
The enterprise legally registered within the territory of China for the sale of products.
2.6 Business user
The company or individual which uses the products for business operations within the
territory of China.
2.7 Self-declaration procedure
The assessment procedure used to determine whether the product meets this Rules
and the applicable standards for compulsory certification.
2.8 Self-declaration
The declaration issued by the producer (manufacturer) based on the results of
conformity assessment to prove that the product meets the requirements of this Rules
and the applicable standards for compulsory certification.
3 Self-declaration procedures
3.1 Self-declaration procedures
3.2 Classification of self-declaration procedures
The self-declaration procedures, according to different types of conformity
assessment methods, are classified into self-declaration procedure A and
self-declaration procedure B.
3.2.1 Self-declaration procedure A
The self-declaration procedure A applies for conformity assessment as follows.
The self-selected laboratory conducts the type test and issues the type test report.
The producer (manufacturer) organizes a self-inspection of its factory's quality
assurance capability and issues a self-inspection report. The self-selected laboratory
shall meet the requirements specified in Article 3.2.3.
3.2.3 Requirements for self-selected laboratory
The operation of the self-selected laboratory shall be in accordance with the laws and
regulations of the country (region) in which it is located. It shall have the testing ability
of the applicable standards for compulsory certification.
3.2.4 Requirements for certification body
The certification body shall be established in accordance with the law, shall comply
with the ��Requirements for the Management Methods of Certification Body�� and have
the certification qualifications in the corresponding fields.
4 Conformity information submission requirements
4.1 System registration
Producers (manufacturers), laboratories and certification bodies involved in
self-declaration shall register in the "Compulsory Certification Product Conformity
Self-Declaration Information Submission System" (hereinafter referred to as the
system) and submit relevant organization information and qualification documents.
4.2 Submit conformity information
4.2.1 In general, producers (manufacturers) and authorized representatives (when
applicable) shall submit conformity information as follows.
4.2.2 If the producer (manufacturer) entrusts the design and production of products in
the ODM mode, the conformity information shall be submitted as follows.
4.2.3 Self-selected laboratories and designated laboratories shall, according to the
requirements of the producer (manufacturer) and authorized representative (when
applicable), submit type test reports and related information of their self-declared
products in the system.
4.2.4 When applicable, the relevant certification body shall, in accordance with the
requirements of the producer (manufacturer) and authorized representative (when
applicable), in the system, report the certification certificates, type test reports, factory
inspection reports, and related information of the self-declared products of the
producer (manufacturer) and authorized representative (when applicable).
4.3 SIGN and submit a self-declaration
After the above conformity information is submitted, the system, based on the
submitted information, automatically generates a "Compulsory Certification Product
Conformity Self Declaration". The signatory designated by the producer
(manufacturer) and authorized representative (when applicable) uploads it to the
system after signing and completes the self-declaration submission. Information on
self-declaration can be found on the website of the CNCA.
5 Self-declaration change
When product design, technical characteristics, related China Compulsory
Certification requirements, or other self-declaration information are changed, the
producer (manufacturer) and authorized representative (when applicable) shall,
based on the changes, select an appropriate conformity assessment method to
supplement the assessment of product conformity and update the relevant
information in the system.
6 Self-declaration cancellation
The producer (manufacturer) and authorized representative (when applicable) can
cancel the self-declaration on their own as required. After the cancellation, the system,
as required, keeps the previous-submitted information for future reference.
7 Validity period of self-declaration
The self-declaration is valid for 10 years. When it expires, the system will
automatically deregister it.
8 CCC mark use requirements
Producers (manufacturers) and authorized representatives (when applicable), in
accordance with the requirements of this Rules, complete the self-assessment and
product conformity information submission. After signing the self-declaration, China
Compulsory Certification mark is applied to the product (see the symbol below).
The producer (manufacturer) and authorized representative (when applicable) shall
ensure that the management and use of the CCC mark comply with regulations such
as ��Administrative Measures for China Compulsory Certification�� and ��Announcement
of the CNCA on the Reform of China Compulsory Certification Mark�� (No. 10
Announcement in 2018 by the CNCA).
9 Post-market supervision
9.1 The CNCA is responsible for organizing and implementing the supervision and
management of self-declaration and the use of the CCC mark. Market supervision
authorities at all levels are responsible for supervising and managing self-declarations
and the use of the CCC mark in the regions under their jurisdiction.
9.2 Producers (manufacturers) and authorized representatives (when applicable)
shall cooperate with the post-market supervision and be able to provide CCC
self-declaration and related information in accordance with the requirements of
market supervision authorities.
9.3 When one of the following situations occurs, the producer
(manufacturer)/importer/seller/business user shall stop exit-factory/importing/selling/
using of the self-declaration corresponding products. The system revokes relevant
self-declarations and makes them public. For products with self-declarations revoked,
producers (manufacturers) and authorized representatives (when applicable), within 6
months, cannot declare self-declarations again. T
9.4 When one of the following conditions occurs, the producer (manufacturer) shall
implement rectification and update relevant information. If necessary, producer
(manufacturer)/importer/seller/business user shall stop exit-factory/importing/selling/
use of the self-declaration corresponding products.
9.5 For producers (manufacturers)/importers/sellers/business users who have
experienced the situations listed in Articles 9.3 and 9.4 twice or more, the CNCA will
announce the list and the treatment results.
9.6 When the ODM initial self-declaration or any self-declaration associated with it
experiences the situations listed in Articles 9.3 and 9.4, if there is a problem with
product safety and quality, all ODM-related self-declarations will be subject to the
same treatment measures.
10 Responsibilities and obligations of related parties
The producers (manufacturers), authorized representatives (when applicable), sellers,
importers, and business users, etc. involved in implementing self-declaration in
accordance with this Rules shall, in strict accordance with the requirements of laws
and regulations such as ��Law of the People��s Republic of China on Product
Quality��, undertake the corresponding responsibilities and obligations for product
quality.
