The contract shall include the scope, content, service period, remuneration of the project management work, as well as the relevant clauses on the obligations and liability for breach of contract of both parties. When the construction project management contract is concluded, if the construction organization entrusts the relevant services in such stages as survey, design, warranty as a whole, it shall specify the relevant scope of the service scope, content, service period, remuneration of the relevant services in the contract. 1.0.4 Before the commencement of construction, the building organization shall notify the construction organization in writing of the name of the project management department, the scope, content, authority of the project management, the name of the chief supervisory engineer. 1.0.5 Within the scope of construction project management work, the contact activities involving construction contracts between the building organization and the construction organization shall be carried out via the project management department. 1.0.6 The implementation of construction project management shall be based on the following main basis. 1.Laws, regulations and engineering construction standards; 2.Survey- design documents of construction project; 3.Project management contract and other contract documents of construction project. 1.0.7 Construction project management shall implement the system that the chief project management engineer assumes the responsibility. 1.0.8 Construction project management shall implement information management. 1.0.9 The project management department shall carry out construction project management and related service activities in a fair, independent, honest, scientific manner. 1.0.10 Construction project management and related service activities shall, in addition to complying with this Code, also comply with the relevant current national standards.2 Terms2.0.1 Construction project management enterprise The service institute which is established in accordance with the law and obtains the qualification certificate of engineering management enterprise issued by the competent construction department, is engaged in the construction project management and related service activities. 2.0.2 Construction project management The service activities of the project management department, as entrusted by the building organization and according to the laws and regulations, engineering construction standards, survey-design documents and contracts, in the construction phase, such as controlling the quality, cost, progress of the construction project; managing the contract and information; coordinating the relationship with the relevant parties of the project construction; fulfilling the legal obligations of the Safety production management law on construction project.3 Project management department and facilities3.1 General requirements 3.1.1 When the project management department implements project management, it shall arrange the project management department to station at the construction site. 3.1.2 The supervisory personnel of the project management department shall be composed of the chief project management engineer, specialty project management engineer, supervisor; its professional support and quantity shall meet the needs of construction project management work; if necessary, it may arrange the representative of the chief project management engineer.4 Project management planning and detailed rules4.1 General requirement 4.1.1 The project management planning shall, based on the actual situation of the project, clarify the work objectives of the project management department, determine the specific project management work system, content, procedures, methods, measures. 4.2 Project management planning 4.2.1 The project management planning can be prepared by the chief project management engineer after signing the construction project management contract and receiving the engineering design documents. It shall be submitted to the building organization before the first meeting at site. 4.2.4 In the process of implementing construction project management, when the project management planning needs to be adjusted due to the change of the actual situation or conditions, it shall be modified by the specialty project management engineer under the organization of the chief project management engineer, approved by the technical responsible person of the construction project management enterprise, then reported to the building organization. 4.3 Detailed rules for project management 4.3.5 During the implementation of the construction project management, the detailed rules for project management may be supplemented and revised according to the actual situation; it shall be implemented after approval by the chief project management engineer.5 Controlling for construction quality, cost, scheduleand site safety management 5.1 General requirement 5.1.1 The project management department shall, based on the agreements of the construction project management contract, according to the principle of dynamic control, adhere to the principle of focusing on prevention, 5.1.3 Before the commencement of the project, the project management personnel shall attend the first site meeting as hosted by the construction organization. The minutes of the meeting shall be organized by the project management department, signed jointly by the representatives of the participating parties. 5.1.6 The project management department shall review the construction program as reported by the construction organization for review. When it meets the requirements, it shall be signed by the chief project management engineer and reported to the building organization. 5.1.7 The application-for-review form of construction program or (special) construction plan shall be filled in accordance with the requirements of Table B.0.1 of this Code. 5.2.6 The application-for-review form of the survey results for construction control shall be filled in according to the requirements of Table B.0.5 of this Code. 5.2.7 The specialty project management engineer shall inspect the laboratory where the construction organization provides services for the project. The laboratory inspection shall include the following. 5.2.8 The laboratory’s application-for-review form of the construction organization shall be filled in according to the requirements of Table B.0.7 of this Code. 5.2.9 The project management department shall examine the quality certification documents for the materials, components, equipment used in the project as submitted by the construction organization. It shall, according to relevant requirements and the requirements of the construction project management contract, conduct sampling witness and parallel testing of the materials for the project. 5.2.10 The specialty project management engineer shall review the inspection and verification report of the measuring equipment that affect the quality of the project as submitted by the construction organization regularly. 5.2.16 For quality defects that require rework or reinforcement, the project management department shall require the construction organization to submit a treatment plan approved by the design and other relevant units, carry out follow-up inspection for the handling process of the quality defects, conduct inspection and acceptance of the handling results. 5.2.19 After the acceptance of project completion is completed, the project management department shall prepare a project quality assessment report, which shall be reviewed and signed by the chief project management engineer and the technical responsible person of the project management department, before being reported to the building organization.6 Settlement of construction changes, claims and construction contract disputes6.1 General requirement 6.1.1 The project management department shall conduct construction contract management in accordance with the construction project management contract, handle such issues as the stoppage and resumption of work, project changes, claims, construction contract disputes, dismissal. 6.2 Construction stoppages and resumptions 6.2.1 When the chief project management engineer issues a project stoppage order, it may, according to the impact range and impact degree of the cause of stoppage, determine the scope of stoppage; according to the requirements of the construction contract and the construction project management contract, sign-off the project stoppage order. 6.2.3 The chief project management engineer shall, when signing off the project stoppage order, obtain the consent from the building organization. When it cannot report in case of emergency, it shall make a written report to the building organization afterwards. 6.2.6 When the construction is suspended due to the reasons of construction organization, the project management department shall inspect and accept the process and result of stoppage correction of the construction organization. A.0.7 of this Code. 6.3 Construction changes 6.3.1 The project management department may handle the project changes as proposed by the construction organization in accordance with the following procedures. 6.7 Construction contract termination 6.7.1 When the construction contract is terminated due to the construction organization, the project management department shall, in accordance with the construction contract, negotiate with the building organization and the construction organization to determine the amount due for the construction organization based on the following items, sign-off a project cost payment certificate. 6.7.2 When the construction contract is terminated due to the reasons of the construction organization, the project management department shall, according to the construction contract, determine the amount due for the construction organization or the amount payable back to the building organization, consult with the building organization and the construction organization, submit a written proof of the amount due for the construction organization or the amount payable back to the building organization.7 Project document & data management7.1 General requirement 7.1.1 The project management department shall establish and improve the management system for the project management documents. It should arrange special personnel to manage the project management documents & data. 7.2 Project document & data contents 7.2.2 The project management daily record shall include the following main contents. 7.2.3 The project management monthly report shall include the following main contents. 7.2.4 The summary of project management work shall include the following main contents. 7.3 Project document & data filling8 Procurement and manufacturing supervision for equipment8.1 General requirements 8.1.1 The project management department shall allocate the project management personnel according to the equipment procurement and manufacturing supervision of equipment as stipulated in the construction project management contract, clearly define the duties of the post. 8.2 Equipment procurement 8.2.1 When the procurement of equipment is carried out by means of bidding, the project management department shall assist the building organization to organize bidding for equipment procurement in accordance with relevant requirements. When using other methods for equipment procurement, the project management department shall assist the building organization to make an inquiry. 8.3.1 The project management department shall inspect the quality management system of the equipment manufacturer, review the equipment manufacturing production plan and process plan as submitted by the equipment manufacturer. 8.3.2 The project management department shall review the inspection plan and 8.3.6 The project management department shall inspect and supervise the assembly process of the equipment. 8.3.7 If the original design of the equipment needs to be changed during the equipment manufacturing process, the project management department shall review the design changes, coordinate the handling of the costs and schedule adjustments as caused by the changes, report to the building organization for approval. 8.3.12 The specialty project management engineer shall review the claim documents as submitted by the equipment manufacturer, propose the opinions, report to the chief project management engineer. The chief project management engineer, building organization, equipment manufacturer shall reach an agreement through negotiation and sign the opinions.9 Related services9.1 General requirements 9.1.1 The project management department shall, according to the relevant service scope as stipulated in the construction project management contract, carry out relevant service work and prepare relevant service work plans. 9.2 Survey & design services 9.2.1 The project management department shall assist the building organization in preparing the engineering survey-design task book and selecting the engineering survey-design organization, assist in signing the engineering survey-design contract. 9.2.4 The project management department shall check the implementation of the survey schedule, supervise and urge the survey organization to complete the work content as agreed in the survey contract, review the payment application form for the survey fee as submitted by the survey organization, sign-off the payment certificate of survey fee, report to the building organization. 9.2.5 The project management department shall inspect the implementation of the survey plan by the survey organization, conduct site inspection of the exploration and testing at key points. 9.2.7 The application-for-review form of survey results can be filled in according to the requirements of Table B.0.7 of this Code. 9.2.8 The project management department shall, according to the design contract and the overall plan requirements of the project, review the design schedule of each specialty and each stage. 9.2.17 The project management department shall, according to the survey- design contract, coordinate the handling of such issues as delay of survey- design, cost claim. 9.3 Maintenance services 9.3.1 When undertaking the service work during the engineering warranty phase, the engineering project management organization shall return to the project regularly. 9.3.2 For the quality defects of the project as proposed by the building organization or the user organization, the project management department shall arrange the project management personnel to make inspection and recording, request the construction organization to make repair, supervise its implementation, sign-approve it after it is qualified. ......Source: Above contents are excerpted from the full-copy PDF -- translated/reviewed by: www.ChineseStandard.net / Wayne Zheng et al.
