Foreword

This Part of GB 5296 is mandatory, except that Chapter 7 is a recommended clause. This Part replaces GB 5296.3-1995, Instruction for use of consumer products. General labelling for cosmetics. From the date of implementation of this Part, cosmetics that are manufactured and imported and sold within the territory of the People's Republic of China shall comply with the requirements of this Part. Compared with GB 5296.3-1995, the main changes in this Part are as follows. -- Add the quote of “Measures for the Metrological Supervision and Administration of Quantitatively Packed Commodities”, Order No. 75 of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China; -- Add the quote of “Measures on Implementation of the Administrative Regulations on Production License of Industrial Products of the People’s Republic of China”, Order No. 80 of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China; -- Delete the statement that the product can have a mitigating effect on the part of use in the definition of cosmetics in 3.1; -- Supplement the terms and definitions of 3.5, 3.6 and 3.7; -- Add the labelling form of b) in Chapter 4; -- Add requirements for labelling cosmetic ingredients; -- Add terms that are exempted from labelling in 8.2; -- Add the use of minority characters at the same time in the cosmetic labelling in 9.3. This Part was proposed by China National Light Industry Council. This Part shall be under the jurisdiction of National Technical Committee 257 on Fragrance and Flavor Cosmetic of Standardization Administration of China. The drafters of this Part. 1 Scope

This Part of GB 5296 specifies the forms, basic principles, labelling contents and labelling requirements of the general labelling for cosmetic sales packaging. This Part applies to cosmetics that are sold in the People's Republic of China.

2 Normative references

The terms in the following documents become the terms of this Part by reference to this Part of GB 5296.For dated references, all subsequent amendments (not including errata content) or revisions do not apply to this Part. However, parties to agreements that are based on this Part are encouraged to study whether the latest versions of these documents can be used. For undated references, the latest edition applies to this Part.

3 Terms and definitions

The following terms and definitions are applicable to this Part of GB 5296. 3.1 Cosmetics A product that is applied to any part of the human body surface (such as skin, hair, nails, lips) by smearing, sprinkling, spraying or the like, so as to achieve clean, fragrant, changing appearance, correcting body odor, maintaining and keeping good condition. 3.2 Labelling Texts, numbers, symbols and patterns that are affixed or attached to or printed on the cosmetic sales package, and instructions that are placed in the sales packaging. 3.6 Visible panels Any surface that the consumer can see under the circumstance that the sales packaging of the cosmetics is not destroyed. 3.7 Net content The actual mass or volume or length of the contents after removal of the packaging container and other packaging materials.

4 Labelling forms

According to the shape and/or volume of the cosmetic packaging, the following labelling forms can be selected.

5 Basic principles

5.1 The contents that are marked on the cosmetics label shall be true. All texts, numbers, symbols, and patterns shall be correct.

6 Contents that must be marked

6.1 Name of the cosmetics 6.1.1 The name of the cosmetics shall reflect the true nature of the cosmetics, which is simple and easy to understand. 6.2 Name and address of the producer 6.2.1 The name and address of the producer who is legally registered and bears the responsibility for cosmetic quality shall be marked. 6.2.2 The name and address of the producer who is entrusted to produce or process the cosmetics shall be marked in accordance with the provisions of the Order No. 80 of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China. 6.3 Net content 6.3.1 Quantitatively packaged cosmetics shall be marked with the net content in accordance with the provisions of the Order No. 75 of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China. 6.4 Cosmetic ingredients list1) 6.4.1 The name of all ingredients of the cosmetics shall be truthfully marked on the visible panels of the sales packaging of the cosmetics. 6.4.2 The ingredient list shall be derived from the guidance of “ingredients.”. 6.4.3 Labelling order of ingredient names 6.4.4 Labeled ingredient names 6.4.4.1 The labeled ingredient names shall be the name of the ingredient in the Chinese Translation of International Nomenclature of Cosmetic Ingredients (INCI). If the ingredient is not covered by the Chinese Translation of International Nomenclature of Cosmetic Ingredients (INCI), the name in Pharmacopoeia of the People’s Republic of China, the chemical name or the botanical name may be used in turn. 6.4.4.2 The fragrance, auxiliary ingredients and carrier in the essence may not be marked with the respective ingredient names; instead, the word “essence” can be listed in the ingredient list. 6.5 Shelf life 6.5.1 The shelf life shall be marked in one of the following two ways. 6.5.2 Labelling method 6.5.3 In addition to the production batch number, the expiry date or the date of manufacture and the shelf life shall be indicated on the visible panels of the sales packaging of the cosmetics. 6.6 The production license number, health license number and product standard number of the enterprise shall be marked, and the product standard number may not be marked without the year number. For products without a production license and/or a health license, it is not required to be marked with the production license number and/or the health license number. The production license number and health license number shall be marked on the visible panels of the sales packaging of the cosmetics. 6.7 Imported non-special-purpose cosmetics shall be marked with the document number of health license of the imported cosmetics.

7 Contents that shall be marked

7.1 If necessary, the instructions for use of the cosmetics or the illustration for the use guide shall be marked.

8 Others

8.1 For products with a net content of not more than 15 g or 15 mL, only contents of 6.1, 6.3, 6.4, 6.5 and the name of producer in 6.2 shall be marked. The contents of 6.4 may be marked in the explanatory materials other than that in a), b) and c) of this Part of GB 5296.

9 Basic requirements

9.1 The content of the cosmetic labelling shall be clear and shall be guaranteed to be eye-catching, easy to identify and read at the time of purchase. 9.2 The texts that are used in the cosmetic labelling shall be the standardized Chinese characters, in addition to the trademarks that are registered according to law. ......
