Regarding the normative documents such as relevant CCC certification implementation rules, formulated by Certification and Accreditation Administration of the PRC (hereinafter referred to as CNCA) before the issuance of this Rules; as well as the relevant technical and procedural documents formulated by each certification body itself; if they are not in conformity with this Rules, this Rules shall prevail. 3 Responsibility In accordance with the provisions of this Rules, each certification body implements the cancellation, suspension, and withdrawal of CCC certification certificates. The CNCA is responsible for the supervision and management of the cancellation, suspension and withdrawal of certificates by various certification bodies. 4 Cancellation of certification certificates 4.1 When one of the following situations occurs, the certification body shall cancel the certification certificate: (1) The validity period of the certification certificate has expired; and, the certification client has not applied for an extension of use; (2) The certification client/manufacturer ceases to produce certified products due to enterprise bankruptcy, closure, dissolution, production structure adjustment, etc.; and, the certification client voluntarily abandons maintaining the certification certificate; (3) The certified product model has been included in the catalog of products, which are explicitly eliminated or prohibited from production by the state; (4) The certification client applies for cancellation; departments or certification bodies in taking samples from the market or sales premises for testing in accordance with the CCC certification implementation rules; (7) The information of the certification certificate (such as the name or address of the applicant/producer/manufacturer, the model or specification of the certified product, etc.) has changed. Or, there is evidence that the organization structure and quality assurance system of the manufacturer have undergone major changes. But the certification client has not applied to the certification body for change approval or filing; (8) Due to the seasonality of production, make-to-order production, etc., the certification client applies for suspension of the certification certificate; (9) Other situations where the certification certificate shall be suspended. 5.2 Relevant regulations on the suspension of certification certificates (1) The certification certificate, during the suspension period, shall be deemed invalid. During the suspension period, the products, covered by the certification certificate, must not leave the factory or be imported. For products covered by the certification certificate that have left the factory or been imported, based on the reasons for the suspension of the certificate, the certification body must evaluate the potential safety hazards of the products. If it may cause harm to human health and life safety, it shall, in accordance with relevant regulations, promptly notify the quality inspection department or take corresponding measures. (2) Due to acceptable reasons such as seasonality of production, make-to-order production, etc., if the certification client proposes to suspend the certification certificate, the maximum suspension period of the certification certificate is 12 months. And the application must be submitted at least 1 month in advance. Except for this situation, if the certification certificate is suspended due to other reasons mentioned in clause 5.1 above, the maximum period of certificate suspension is 3 months. The suspension period shall be counted from the date when the certification body issues the suspension notice. 6 Restoration of suspended certification certificates 6.1 For certification certificates that have been suspended due to various circumstances in clause 5.1, the certification body must inform the certification client of the reasons for the suspension of the certificate and the time limit; and based on the reasons for the suspension, specify the relevant requirements for the restoration of the certificate. 6.2 Within the time limit for the suspension of the certification certificate, the certification client may apply to the certification body for restoration. If the certification client has passed the rectification according to the relevant regulations (1) From the date of withdrawal of the certification certificate, the products covered by the certification certificate must not leave the factory, be sold, imported, or used in other business activities. Based on the reasons for the withdrawal of the certificate, the certification body must evaluate the potential safety hazards of the products. If it may cause harm to human health and life safety, it shall, in accordance with relevant regulations, promptly notify the quality inspection department or take corresponding measures. (2) After the certification certificate is withdrawn, it must not be restored for any reason. After rectification, the certification client can apply for certification again to the certification body. For products whose certification certificates have been withdrawn, the corresponding product type test reports and factory inspection reports are no longer valid. Within 6 months, any certification body must not accept the certification entrustment of the product. When the certification body accepts certification applications with product type test reports and factory inspection reports, it shall formulate strict review procedures; carefully confirm whether the product applying for certification has the certification certificate withdrawn; and whether the corresponding product type test report and factory inspection report are valid. 8 Information communication The certification body shall notify the certificate holder in an appropriate manner on the day when the cancellation, suspension (including restoration), or withdrawal of the certification certificate is made. And within 5 working days from the date of cancellation, suspension (including restoration), or withdrawal of the certification certificate, it shall formally notify the holder of the certificate in writing; inform the reason and the necessary measures to be taken in the next step; and in an appropriate manner, keep a record that the certification certificate holder has learned this information. After the certification certificate is cancelled, suspended (including restoration), or withdrawn, in accordance with the requirements of the CNCA CCC certification information data reporting work, the certification body must report to the CNCA Information Center in a timely manner; as well as the provincial, autonomous region, and municipal quality and technical supervision bureaus, and the certification regulatory agencies directly under the inspection and quarantine bureaus. The CNCA Information Center shall publish relevant information in a timely manner; so that all interested parties (such as local law enforcement agencies, sellers, consumers, etc.) can effectively obtain information about the status of the certification certificate and its status changes (including the time, reason, deadline of the change, etc.). In daily work, the certification body shall strengthen information communication and cooperation with local certification supervision departments and law enforcement (audit) departments; timely collect illegal information from regulatory enforcement, special supervision and spot checks at all levels, complaints from related parties, media exposure, ......
